These terms govern use of the Amanah Sejati website and the engagement of our inheritance law advisory services. Please read them carefully before making an enquiry or instruction.
1. Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- “We” / “Us” / “Our” / “the Practice” — Amanah Sejati, a legal advisory practice registered in Johor, Malaysia.
- “You” / “Client” — any person who uses this website or engages our advisory services.
- “Services” — the inheritance law advisory services described on this website, including will validity counsel, faraid distribution advisory, and contested probate representation.
- “Engagement” — a formal instruction to provide Services, confirmed by an engagement letter or written agreement.
- “Website” — the site accessible at amanahse.sbs and all pages and resources associated with it.
2. Acceptance of Terms
By accessing the Website or submitting an enquiry, you confirm that you have read these Terms and Conditions and agree to be bound by them. If you do not agree, please do not use the Website or submit an enquiry.
Our Services are available to persons who are 18 years of age or older and who have legal capacity to enter into an advisory engagement. Where an enquiry is made on behalf of a deceased's estate, the person making the enquiry represents that they are entitled to do so.
3. Services
Amanah Sejati provides the following inheritance law advisory services in Malaysia:
- Will Validity & Construction Counsel — advisory work on the interpretation, validity, and construction of wills.
- Faraid Distribution Advisory — advisory work on Islamic inheritance distribution under the principles of faraid.
- Contested Probate Representation — representation in contested probate matters before civil courts.
Services are provided subject to the terms of a written engagement letter. Information on the Website constitutes a general description only and does not constitute a binding offer to provide any particular service at any particular fee.
4. Engagement Process
An engagement with Amanah Sejati is formed when both parties have signed or otherwise confirmed an engagement letter setting out the scope of work, fees, and terms. An enquiry via this Website or a consultation does not of itself create a legal advisory relationship.
We reserve the right to decline or discontinue an engagement if we determine that doing so is appropriate in the circumstances, including where a conflict of interest is identified.
5. Client Responsibilities
To enable us to advise you effectively, you agree to:
- Provide complete, accurate, and timely information relating to your matter.
- Inform us promptly of any change in circumstances that may affect the matter.
- Use the Website only for lawful purposes and refrain from transmitting any material that is unlawful, harmful, or otherwise objectionable.
- Not attempt to circumvent any security feature of the Website or access parts of the Website not intended for general access.
6. Fees & Payment
Fees for Services are as set out in the engagement letter. The indicative fees displayed on this Website (Will Validity & Construction Counsel — MYR 750; Faraid Distribution Advisory — MYR 880; Contested Probate Representation — MYR 1,420) are starting points only. The actual fee for your matter will be confirmed in the engagement letter following an initial consultation.
Fees are payable in Malaysian Ringgit (MYR). Unless otherwise stated in the engagement letter, payment is due within 14 days of invoice. Disbursements (court filing fees, translation costs, and other out-of-pocket expenses) are charged in addition to the advisory fee and will be notified to you in advance where practicable.
If a matter does not proceed beyond an initial consultation, we will confirm in writing whether any consultation fee applies.
7. Confidentiality
We treat all information shared with us in confidence. We will not disclose your information to third parties except as required to carry out your instructions, as set out in our Privacy Policy, or as required by law.
You agree to keep confidential any written opinions, advice, or other work product provided to you and not to share it with third parties without our prior written consent, except as reasonably necessary for the purpose for which it was provided.
8. Intellectual Property
All content on this Website — including text, design, layout, and graphics — is the property of Amanah Sejati or its licensors and is protected by applicable Malaysian and international intellectual property law. You may not reproduce, distribute, or republish any part of the Website without our prior written consent.
Written opinions and advice we prepare for you are provided under a limited, non-exclusive licence for your personal or organisational use in connection with the matter for which they were prepared. They are not to be relied upon by third parties.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot lawfully be limited.
11. Termination
Either party may terminate an engagement by giving reasonable written notice, subject to the terms of the engagement letter. On termination, you will be invoiced for work properly carried out to the date of termination and for any disbursements incurred.
We reserve the right to terminate an engagement or cease providing Website access immediately if you breach these Terms or if continuing would create a conflict of interest or breach of professional obligations.
12. Dispute Resolution
If a dispute arises in connection with these Terms or an engagement, the parties will first attempt to resolve the matter through direct discussion in good faith.
If the dispute is not resolved within 30 days of written notice of the dispute, either party may refer it to mediation before the Malaysian Mediation Centre, or, if mediation is unsuccessful, to the courts of Malaysia.
These Terms and any engagement are governed by the laws of Malaysia. The courts of Johor Bahru, Johor shall have jurisdiction, subject to any mandatory provisions of applicable law.
13. General Provisions
Entire agreement. These Terms and any applicable engagement letter constitute the entire agreement between the parties regarding their subject matter and supersede any prior representations or understandings.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver. A failure by either party to enforce any right under these Terms does not constitute a waiver of that right.
No assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations to a successor practice.
14. Changes to These Terms
We may update these Terms from time to time. Any material changes will be reflected in a revised “Last Updated” date. For ongoing engagements, any changes will be communicated directly. Your continued use of the Website after a change constitutes acceptance of the updated Terms.
