A Practice Built on Discretion and Care

Sensitive to the Moment

Inheritance matters often arise in the midst of bereavement. We approach every enquiry with patience and tact, pacing the work to suit the family's readiness.

Deep Familiarity with Malaysian Law

Our advisory practice covers both civil and Syariah inheritance frameworks — the Probate and Administration Act, faraid jurisprudence, and the interplay between them where relevant.

Clear Written Opinions

Where advisory work warrants it, we provide a written legal opinion in plain language — something families can refer back to as they make decisions about the estate.

Family-Centred Communication

We speak to all relevant family members with equal attentiveness, recognising that inheritance decisions affect a wider circle than just the named parties in a document.

Based in Johor Bahru

Our office on Jalan Tun Abdul Razak is accessible to families across southern Johor. Appointments can be arranged at times suited to those travelling from further afield.

Transparent Advisory Fees

Fees are stated clearly at the outset. There are no retainer surprises — the scope of each engagement is discussed and agreed before work begins.

Common Questions

Frequently Asked Questions

How do I know if a will is legally valid in Malaysia?
For a will to be valid under Malaysian civil law, it must generally be made in writing, signed by the testator in the presence of two witnesses, and those witnesses must also sign. Where capacity is in question — for instance if the testator was elderly or unwell — the circumstances of execution become particularly important. We can review the documentation and advise on whether questions of validity are likely to arise.
What is faraid and does it apply to my family's estate?
Faraid is the system of inheritance prescribed under Islamic jurisprudence, and in Malaysia it applies to the estates of Muslim individuals. It defines specific fractional shares for recognised categories of heirs. It is separate from — and in many respects operates differently to — civil probate law. If the deceased was Muslim, faraid principles will typically govern the distribution of at least part of the estate, and coordination with the Syariah court may be required.
Can a will be challenged after the deceased has passed?
Yes, a will can be contested after the testator's death. Common grounds include lack of testamentary capacity, undue influence, fraud, or procedural defects in execution. Contested probate proceedings are handled in the civil courts, and the process can be lengthy. We can advise on the merits of a challenge before any formal steps are taken, which helps families make considered decisions about whether to proceed.
How long does the probate process typically take?
Straightforward uncontested probate in Malaysia may be resolved within several months, though delays at the court registries are common. Where a matter is contested, the timeline extends considerably — proceedings can take one to several years depending on the complexity of the dispute and the court's schedule. We keep clients informed of realistic timeframes at each stage so that expectations remain grounded.
What documents should I bring for an initial consultation?
It is helpful to bring whatever documentation you have available — the will itself, any codicils, the death certificate, and any correspondence from other parties or solicitors. If you are seeking faraid advice, a list of known assets and the names and relationships of the potential heirs is useful. We understand that families are not always in possession of complete records, and we can guide you on what to gather after the initial meeting.
Are your fees fixed or do they vary with the complexity of the matter?
Our advisory fees for will validity and faraid work are stated as a starting figure, and the final fee for more involved matters will be discussed and agreed before work proceeds beyond an initial assessment. For contested probate representation, fees reflect the scope and duration of the proceedings, and we provide a written cost estimate before any litigation steps are taken. We do not commence significant work without your clear agreement on the fee arrangement.
