Our Story

How Amanah Sejati Came to Be

Amanah Sejati was founded with a clear purpose: to bring attentive, specialised counsel to families in Johor Bahru and the surrounding region who find themselves managing an estate — often at a time of personal difficulty.

The practice grew from years of work in estate and probate matters within the Malaysian civil and Syariah frameworks. Over time, a consistent observation emerged: families frequently encountered well-intentioned but generalised legal advice that did not account for the particular character of inheritance law — its intersection with familial relationships, its procedural particularities, and its sensitivity when matters become contested.

That observation shaped the practice. At Amanah Sejati, inheritance law is not one offering among many — it is the entire focus. This depth allows us to draw on accumulated experience across will construction disputes, faraid calculations, Letters of Administration applications, and contested probate proceedings before both the civil and Syariah courts.

The name reflects our orientation. Amanah — the trust placed in us by families at a vulnerable moment — is the measure by which we assess our own conduct. Malaysian inheritance law sits at the intersection of civil statute, common law precedent, and — for Muslim estates — the Syariah framework. The Probate and Administration Act 1959 governs the administration of non-Muslim and non-faraid estates through the civil courts, while Muslim estates are subject to the faraid provisions under Islamic jurisprudence as applied through the Syariah courts in each state.

In practice, many estates involve both frameworks: a Muslim individual may hold assets in joint names with a non-Muslim spouse, or nominate beneficiaries under schemes that interact imperfectly with the faraid rules. Navigating these intersections requires familiarity with both legal systems and an understanding of how the courts in Johor have approached particular questions.

Will disputes frequently turn on questions of capacity — whether the testator understood the nature and effect of the document they were signing — or on questions of undue influence, where a family member or other party is alleged to have exerted improper pressure.
