Three Matters in Detail
Disputed Testamentary Capacity — Johor Bahru
The Situation
An elderly woman's will, made six months before her death, was questioned by one of her adult children on the basis that she had been diagnosed with early-stage dementia at the time of signing.
The Advisory Work
We reviewed the medical records, the circumstances of execution, and the content of the will. We provided a written opinion on testamentary capacity and on the likely outcome of a challenge — including an honest assessment of its merits.
The Outcome
Armed with a clear written opinion, the family reached a mutual agreement without commencing proceedings. The estate was administered in accordance with the will within four months of the initial enquiry.
Faraid Distribution — Mixed-Asset Estate, Segamat
The Situation
A Muslim man passed without a written will. His estate comprised agricultural land, a residential property, and a number of financial accounts. Seven potential heirs held different views about the distribution.
The Advisory Work
We undertook a complete faraid calculation with written workings, coordinated the estate inventory with the family, and liaised with the Johor Syariah Court to progress the distribution application.
The Outcome
The distribution was completed with the agreement of all seven heirs within seven months. Three heirs who had initially questioned the calculation later acknowledged that the written explanation had resolved their concerns.
Contested Executor Appointment — Kluang
The Situation
A deceased man's will named one sibling as sole executor. Two other siblings sought to have the appointment challenged, alleging the named executor had a conflict of interest with a substantial asset in the estate.
The Advisory Work
We represented the challenging siblings in their application before the High Court. Submissions were prepared addressing both the conflict of interest and the named executor's suitability for the role.
The Outcome
The court appointed a neutral administrator in place of the named executor. Administration of the estate proceeded without further dispute. Total proceedings duration: eleven months from first enquiry to resolution.
